교민들의 권리를 지키기 위한 호소문

한인회는 모든 교민에게 열린 단체여야 합니다.

회비를 내고 행사 참여 조건까지 충족해도, 이사회 심사에 따라 가입이 제한될 수 있다면, 그 판단 기준과 이의제기 절차는 무엇입니까?

매니토바주에 거주하거나 생활기반을 둔 18세 이상의 한인 및 그 직계 가족을 정회원으로 한다.

매니토바주에 거주하거나 생활기반을 둔 18세 이상의 한인으로, 매년 회비를 납부하고, 연 1회 이상 한인회가 주관하는 행사에 참여한 사람만을 정회원으로 한다. 다만, 이 조건을 충족하더라도 이사회가 필요로 할 경우 가입 여부를 심사하여 결정할 수 있다.

① 회원 심사의 기준과 공정성

가입 조건을 충족한 사람을 추가로 심사한다면, 심사 사유와 기준, 결정 기한, 거절 사유 통지, 이의제기 절차가 공개되어야 합니다. 의견이 다르다는 이유로 가입이 제한되는 일이 없도록 객관적인 운영 기준이 필요합니다.

② 총회 24시간 전 회비 납부 조건

회비가 운영에 필요하다는 점은 이해합니다. 다만 총회 개최 24시간 전까지 납부해야 하는 이유와 그 근거는 명확하게 설명되어야 합니다.

마감 직전에 납부한 사람의 행사 참여 여부와 회원 자격은 누가, 언제, 어떤 절차로 확인합니까? 총회 참석과 의결권 행사 여부를 미리 알 수 있는 일관된 절차가 필요합니다.

③ 연 1회 이상 행사 참여 조건

행사 참여를 장려하는 것은 바람직하지만, 생업·건강·돌봄 등으로 참석하기 어려운 교민도 있습니다. 참여 횟수를 회원 자격의 필수 조건으로 삼는 것이 적절한지 검토해야 합니다.

인정되는 행사의 범위, 참여 산정 기간과 확인 방법, 불가피한 사정에 대한 예외도 명확히 안내해야 합니다.

④ 직계 가족 조항의 변경

제공된 변경 문구에는 기존의 “그 직계 가족”이라는 표현이 빠져 있습니다. 이 변경이 가족 구성원의 회원 자격에 어떤 영향을 미치는지, 삭제 이유와 적용 범위를 설명해 주시기 바랍니다.

⑤ 적용 법률과 개정 절차의 확인

해당 조건이 곧바로 법률 위반에 해당한다고 단정하기보다, 한인회의 설립 근거와 적용 법률, 회칙 개정 절차, 회원 자격 제한의 적법성을 확인할 필요가 있습니다. 관련 검토를 받았다면 그 내용과 공개 가능한 근거를 설명해 주시기 바랍니다.

한인회에 요청합니다

1. 개정 회칙 전문과 총회 의결 결과를 공개해 주십시오.
2. 회비 금액·납부 기한·회원 심사 기준을 명확히 안내해 주십시오.
3. 가입 거절 시 사유 통지와 이의제기 절차를 마련해 주십시오.
4. 교민들의 의견을 수렴하여 불필요한 참여 장벽을 재검토해 주십시오.

A public appeal concerning membership and participation

An Appeal to Protect the Rights of the Korean Community

The Association should remain open to the entire Korean community.

If someone pays the fee and meets the participation requirement but may still be denied membership following Board review, what criteria and appeal procedures apply?

Koreans aged 18 or older who reside in or have an established base of life in Manitoba, and their immediate family members, are full members.

Only Koreans aged 18 or older who reside in or have an established base of life in Manitoba, pay the annual membership fee and attend at least one Association-organized event each year are full members. However, even when these conditions are met, the Board may review and decide whether to admit an applicant if it considers such a review necessary.

① Fair and Transparent Membership Reviews

If applicants who meet the stated conditions face further review, the grounds, criteria, decision timelines, reasons for refusal and appeal process should be public. Objective standards are needed to prevent exclusion merely because someone holds a different opinion.

② The 24-Hour Fee Payment Deadline

We recognize that membership fees support the Association. However, the reason and basis for requiring payment at least 24 hours before the General Assembly should be clearly explained.

Who checks the eligibility and event attendance of someone who pays just before the deadline, and when? A consistent process should allow members to know in advance whether they may attend and vote.

③ Mandatory Annual Event Attendance

Encouraging participation is worthwhile. However, work, health and caregiving responsibilities can prevent attendance. Whether an attendance quota should determine membership eligibility needs reconsideration.

Qualifying events, the assessment period, attendance verification and exceptions for unavoidable circumstances should also be clear.

④ The Change Affecting Immediate Family Members

The supplied revised wording omits the previous reference to “their immediate family members.” Please explain the reason for this omission and how it affects family members’ eligibility.

⑤ Applicable Law and the Amendment Procedure

Rather than assuming these conditions violate the law, the Association’s incorporation framework, applicable legislation, amendment procedure and membership restrictions should be examined. If a legal review has been obtained, please explain its findings and share any supporting information that can be made public.

What We Ask of the Association

1. Publish the complete revised bylaws and the General Assembly’s decisions.
2. Clearly explain fees, payment deadlines and membership review criteria.
3. Provide reasons for membership refusals and an appeal process.
4. Consult community members and reconsider unnecessary barriers to participation.
